9th Circ. Lifts Ban On Political Ads On Public Stations

Law360, New York (April 12, 2012, 5:31 PM EDT) -- The Ninth Circuit on Thursday struck down a Federal Communications Commission rule prohibiting public broadcast radio and television stations from airing public issue and political advertisements, while upholding a ban on ads for for-profit companies' goods and services.

In a 2-1 ruling, a three-judge panel upheld the federal ban on ads for for-profit entities while contesting a ban on certain types of noncommercial speech on public airwaves as an unconstitutional violation of the First Amendment.
