National Union Wins $49M Carbon Black Coverage Appeal

Law360, New York (April 17, 2012, 3:58 PM ET) -- A Texas appeals court on Tuesday affirmed earlier rulings that found Continental Carbon Co.'s umbrella policies didn't require its insurer to cover $28 million in legal fees and a $20.7 million settlement from pollution suits over a Continental carbon black factory in Alabama.

The insurer, National Union Fire Insurance Co. of Pittsburgh, Pa., triumphed in a 2010 arbitration of the dispute, where arbitrators found the policy didn't cover damages from carbon black dust that allegedly escaped the plant, and a Texas state court confirmed the award...
