Va. High Court Upholds Steadfast's Win In AES Climate Suit

Law360, New York (April 20, 2012, 8:15 PM EDT) -- The Virginia Supreme Court unanimously reaffirmed Friday after a rehearing that Steadfast Insurance Co. isn't required to defend energy company AES Corp. against claims its greenhouse gas emissions destroyed the Alaskan coastal village of Kivalina by contributing to global warming.

The state's highest court, which first ruled on the matter in September, again found AES' policy with Zurich Insurance Group Ltd. affiliate Steadfast only applies to claims arising from accidental occurrences.
