Law360, New York (April 24, 2012, 3:05 PM ET) -- A Louisiana federal judge on Monday prevented plaintiffs in a $220 million Vioxx class action in Missouri against Merck & Co. Inc. from pursuing damages over product liability claims that were already resolved in multidistrict litigation settlements.
Taking the rare step of intervening in a state court proceeding, U.S. District Judge Eldon E. Fallon said the strategy that the Missouri plaintiffs were using encroached on the MDL settlements.
