Blue Cross Insurers Face Class Cert. Motions In ERISA Suit

Law360, New York (April 24, 2012, 5:46 PM EDT) -- Health care providers in several states Tuesday asked a judge to certify classes in litigation accusing various Blue Cross and Blue Shield entities of breaching the Employee Retirement Income Security Act when they retroactively denied benefits.

According to the providers, Blue Cross insurers would issue payments for services and later, with little explanation, say the payments were issued in error. If money wasn't returned, Blue Cross would withhold funds for services that hadn't yet been reimbursed, the providers say.
