BNSF Railway Settles With EPA Over RCRA Allegations

Law360, New York (April 26, 2012, 1:55 PM EDT) -- BNSF Railway Co. reached an agreement with the U.S. Environmental Protection Agency on Wednesday that resolves claims that it violated the Resource Conservation and Recovery Act at a Superfund site in Portland that was contaminated with a dangerous pesticide.

The Berkshire Hathaway Inc. subsidiary will pay a $37,500 penalty to settle the administrative action. The EPA targeted the handling of soil excavated at the site by contractors for the company. The site is a former McCormick and Baxter Creosoting Co. wood treating facility on the banks...
