NY Times Sues DOJ Over Cordray, NLRB Appointment Docs

Law360, New York (April 26, 2012, 1:57 PM EDT) -- The New York Times Co. on Tuesday alleged the U.S. Department of Justice improperly withheld documents about President Barack Obama’s January recess appointment of Richard Cordray to the Consumer Financial Protection Bureau and three others to the National Labor Relations Board.

The U.S. Department of Justice violated the Freedom of Information Act by not releasing the supporting documentation for a January memorandum that outlined Obama’s authority to make the recess appointments, the Times claims in a lawsuit filed in the Southern District of New York....
