Law360, New York (April 27, 2012, 3:20 PM ET) -- A federal judge on Thursday threw out a California woman’s proposed class action against General Nutrition Corp. that alleged the company illegally requested customers’ ZIP codes during credit card transactions, saying she can’t sue because she used a debit card for her purchase.
The law under which plaintiff Norma Rothman sued GNC, California’s Song-Beverly Credit Card Act, excludes debit cards, U.S. District Judge S. James Otero said in an order denying Rothman’s motion to certify the class and dismissing her complaint.
