9th Circ. Won't Hear Appeal In Apple, AT&T Antitrust Suit

Law360, New York (April 27, 2012, 7:49 PM EDT) -- The Ninth Circuit on Friday denied a bid by a decertified class of iPhone users to appeal a decision that Apple Inc. can force them to arbitrate their antitrust claims against it and AT&T Inc. when only AT&T's contracts included arbitration agreements.

The appeals court's ruling came as a blow to a group of customers who had signed voice and data service contracts with AT&T for their iPhones, although a related suit is currently pending against only Apple in a California federal court.
