NYC Bar Delivers Ethics Guidance On Misdirected Docs

Law360, New York (April 30, 2012, 9:33 PM EDT) -- Lawyers who receive documents sent to them by mistake must promptly notify the sender, though they aren't obligated to destroy them or send them back, the New York City Bar Association's Professional Ethics Committee said in a formal opinion Monday.

The group specified that the opinion, based on Rule 4.4(b) of the New York Rules of Professional Conduct, applied to any form of correspondence — including paper documents, emails and voicemails — from any sender.
