Law360, New York (May 01, 2012, 1:41 PM ET) -- A California appeals court on Monday revived a putative class action claiming Pacific Bell Telephone Co. violated service agreements by including unauthorized charges on telephone bills, ruling the California Public Utilities Commission did not hold exclusive jurisdiction over the dispute.
Disagreeing with a Marin County court that tossed the lawsuit against Pacific Bell and ACI Billing Services Inc. over a prohibited billing practice known as cramming, three appeals judges found the commission lacked even primary jurisdiction to resolve the suit.
