Law360, New York (May 04, 2012, 8:32 PM ET) -- A New York federal judge said Tuesday that an IP address is not sufficient evidence to identify a specific person, in a case involving defendants who allegedly illegally downloaded copyrighted pornographic material from the Internet.
U.S. Magistrate Judge Gary R. Brown held that a person who pays for Internet access at a given location, and thus is associated with the IP address, is not necessarily the same individual who has allegedly downloaded a pornographic film.
