Law360, New York (May 04, 2012, 8:58 PM ET) -- A Second Circuit panel heard oral argument Friday from plaintiffs who sought to revive a putative class action accusing Xerox Corp. of unlawfully terminating health benefits for thousands of retirees, as the company argued that it had the right to cut the benefits.
Attorneys from the plaintiffs, meanwhile, argued that the company had made "constant, continuous assurances, guarantees and promises" that it would continue to provide the benefits and that its reneging on that offer constitutes damages.
