State Farm Wants Out Of Pfizer Trade Dress Suit

Law360, New York (May 10, 2012, 7:03 PM EDT) -- State Farm Fire and Casualty Co. asked an Illinois state judge Wednesday to declare that it owes no defense coverage to an Illinois direct marketer facing trademark infringement claims from Pfizer Inc. for purportedly selling fake Viagra. 

In a suit filed in the Chancery Division of Illinois' Cook County Circuit Court, State Farm said the business liability insurance it sold to telemarketing agency All USA Inc. and its president, Frank Divito, should not apply because the Pfizer action fails to allege an advertising injury.
