Law360, New York (May 14, 2012, 2:00 PM ET) -- A California federal judge on Friday disqualified and fined the lead plaintiff in a class action accusing restaurant chain Red Robin International Inc. of cheating its workers out of overtime pay, blasting the ex-employee's discovery missteps as bordering on perjury.
Judge William Alsup said that former Red Robin waiter Kevin McConnell withheld important information about his contact with prospective class members from the court and that correspondence he disclosed showed he had come very close to asking his former co-workers to lie.
