Law360, New York (May 23, 2012, 1:23 PM ET) -- The Colorado Supreme Court ruled Monday that Sinclair Oil Corp. and other oil companies don’t have the power to condemn land for the construction of pipelines, upsetting what is considered standard practice for the industry.
In a 4-3 decision, the court narrowly interpreted a statute that awards eminent domain authority to "pipeline companies" to mean for the construction of electric power infrastructure, not for oil. Two dissents argued that the statutory language does include oil pipelines.
