West Penn Fights Buyer's Vow To Drop UPMC Antitrust Suit

Law360, New York (May 23, 2012, 5:08 PM ET) -- West Penn Allegheny Health System Inc. on Tuesday fought to keep its antitrust lawsuit against rival University of Pittsburgh Medical Center alive, asserting its right to sue despite a promise from insurer Highmark Inc., its potential buyer, to drop the suit.

Asserting that Highmark's pending $475 million deal to acquire West Penn Allegheny may not happen, the health care company said a UPMC motion to stay the suit, filed earlier this month, would cause it unnecessary hardship.
