Law360, New York (May 24, 2012, 12:36 PM ET) -- Lindt & Spruengli AG on Thursday lost a bid to trademark its iconic gold foil-wrapped chocolate bunnies adorned with red ribbons after the European Union's high court ruled that the treats were not distinctive enough to merit trademark protection throughout Europe.
The Court of Justice of the European Union dismissed Lindt’s appeal as “unfounded,” affirming the ruling by the EU General Court that found one of Lindt's chocolate rabbit designs did not warrant trademark status in every member country in the bloc.
