Common Sense View Doesn't Make Patents Obvious: Fed. Circ.

Law360, New York (May 30, 2012, 5:27 PM EDT) -- The Federal Circuit on Wednesday vacated a district court's finding that held a patent for meat casing was invalid, ruling that the district court erred in its groundless reliance on a common sense view in its obviousness analysis.

In a precedential opinion, a three-judge panel held that the district court wrongly leaned on a common sense view or a common sense approach to hold that it would have been obvious to try a particular meat-casing technique, remanding the case for further proceedings.
