Law360, New York (June 05, 2012, 5:44 PM ET) -- The Third Circuit on Tuesday ruled that distributors of Becton Dickinson & Co.'s hypodermic products, not health care providers, are direct purchasers with standing to pursue federal class action antitrust claims against the medical technology company.
The decision, which reversed a September 2010 ruling by a New Jersey federal court, could revive a $45 million proposed settlement with distributors that was shot down when the court determined that health care providers — the hospitals and clinics that bough Becton Dickinson's products — were the direct purchasers....
