Law360, New York (June 06, 2012, 3:39 PM ET) -- The Ninth Circuit on Monday declined to rehear or rehear en banc a decision affirming a win for DC Comics that allowed it to obtain documents in its battle with the heirs of the creators of “Superman” for rights to the superhero.
Circuit Judges Alex Kozinski, Diarmuid F. O'Scannlain and N. Randy Smith unanimously voted to deny both the petition for a rehearing of the case and the petitioners' suggestion that the case be reheard en banc.
