RyMed Wins Catheter Row After USPTO Nixes Rival's Patent

Law360, New York (June 11, 2012, 8:19 PM ET) -- A RyMed Technology Inc. catheter component does not infringe a patent held by rival Laboratoires Pharmaceutiques Vygon, a Tennessee federal judge ruled Thursday, following a reexamination by the U.S. Patent and Trademark Office.

The USPTO, which issued a reexamination certificate in May, invalidated all but one claim of the patent Vygon alleged the Franklin, Tenn.-based RyMed had infringed by manufacturing the component, U.S. District Judge Kevin Sharp of Tennessee federal court said. The remaining claim was not reviewed as part of the reexamination.
