1st Amendment Protects 'Bama Football Paintings: 11th Circ.

Law360, New York (June 11, 2012, 9:16 PM EDT) -- The Eleventh Circuit on Monday ruled that paintings of University of Alabama football scenes are protected by the First Amendment and do not violate federal trademark law despite including university trademarks like football uniforms.

The appeals court reversed the Northern District of Alabama's summary judgment ruling in part, ruling that artist Daniel A. Moore's paintings, prints and calendars of his alma mater's football games did not need to be licensed by the university.
