States Ask 2nd Circ To Let Vt. Close Entergy Nuclear Plant

Law360, New York (June 11, 2012, 7:19 PM ET) -- A group of state legislatures on Monday urged the Second Circuit to overturn a lower court’s decision that limited Vermont’s authority to close an Entergy Corp. nuclear power plant, saying the judge wrongly found that the Atomic Energy Act preempts the state’s statutes.

The National Conference of State Legislatures and the states of New York, Connecticut, Iowa, Maryland, Massachusetts, Mississippi, Missouri, New Hampshire and Utah filed amicus briefs arguing that the Second Circuit should grant the state of Vermont’s request that it uphold a state law...
