HHS Backs Bar On Medicare Claim Reviews In 9th Circ.

Law360, New York (June 12, 2012, 4:59 PM EDT) -- The U.S. Department of Health and Human Services on Friday defended regulations that bar administrative review of a contractor's decision to reopen a claim for Medicare payment, telling the Ninth Circuit that the regulations do not contradict earlier HHS rules.

Regulations passed in 2005 explicitly state that the decision to reopen a claim is a discretionary action by the contractor and not subject to appeal, the agency argued in a response to amicus briefs filed by the American Medical Association and the California Hospital Association....
