CVS, Rite Aid Latest To Sue Wyeth, Teva Over Effexor

Law360, New York (June 12, 2012, 11:26 PM EDT) -- Rite Aid Corp. and CVS Caremark Corp. are the latest to hit Pfizer Inc. subsidiary Wyeth Inc. and Teva Pharmaceutical Industries Ltd. with antitrust claims Tuesday, saying they conspired to monopolize the sale of the generic version of antidepressant Effexor XR.

Rite Aid and CVS claim Wyeth misrepresented critical information to the U.S. Patent and Trademark Office in order to obtain patents for venlafaxine hydrochloride and brought sham litigation in order to keep other pharmaceutical companies from marketing their generic versions of the drug.
