La. Communities Want Deepwater State Law Claims Revived

Law360, New York (June 14, 2012, 6:58 PM ET) -- Three coastal Louisiana parishes asked the Fifth Circuit on Wednesday to reverse the dismissal of their state law claims in the Deepwater Horizon multidistrict litigation, arguing that the 10th Amendment required the penalty claims in the actions to be remanded to state court.

In their opening brief, Iberia, St. Mary, and St. Tammany parishes argued that federal courts lack jurisdiction under the Outer Continental Shelf Lands Act to bar prosecutions for penalties by the state, seeking a reversal of U.S. District Judge Carl Barbier's December decision...
