Chipotle, Kroger Settle Trademark Row Over Chicken Labels

Law360, New York (June 18, 2012, 5:17 PM ET) -- Grocery store chain Kroger Co. on Monday agreed to discontinue using “chipotle” to market its fried chicken in order to resolve claims by Chipotle Mexican Grill Inc. that the labels sponged off the restaurant chain's goodwill and violated its trademarks.

In a joint motion filed Monday, Kroger and Chipotle asked a Colorado federal court to approve a consent decree the parties had reached in order to settle the trademark infringement dispute over Kroger’s chipotle chicken.
