Apple Accuses Burst Of Unfair Witness Tactics

Law360, New York (September 17, 2007, 12:00 AM EDT) -- Apple Computer Inc. has taken another shot at Burst.com Inc. in a patent infringement lawsuit over devices used in iTunes, iPods and QuickTime streaming products, arguing that the media delivery technology company is unfairly limiting Apple’s ability to cross-examine Burst’s witnesses.

In court documents filed Monday in the U.S. District Court for the Northern District of California, Apple accused Burst of repeatedly instructing its witnesses not to answer important questions, a tactic Apple said has successfully limited its ability to cross-examine Burst’s witnesses.
