Boston Scientific Stents Again Beat J&J Infringement Claims

Law360, New York (June 20, 2012, 2:17 PM EDT) -- A Delaware federal judge ruled Monday that Boston Scientific Corp.'s drug-eluting Promus stents don't infringe three patents held by Johnson & Johnson subsidiary Cordis Corp., the latest victory for Boston Scientific in its "Stent Wars" with J&J.

U.S. District Judge Sue L. Robinson decided that an earlier ruling by the Federal Circuit that found older but related Cordis patents didn't infringe Boston Scientific stents prevented Cordis from arguing that the newer patents-in-suit in the case before her were being infringed by Boston Scientific's stents.
