Mont. High Court OKs Gas Wells Despite Sage Grouse Threat

Law360, New York (June 20, 2012, 6:08 PM EDT) -- Montana's Supreme Court on Tuesday rejected an appeal by environmentalists who said that a state board's issuance of 23 natural gas well permits in the eastern part of the state posed a threat to imperiled sage grouse.

With two of the seven justices dissenting, the state high court ruled that a district court was correct when it said that the Montana Board of Oil and Gas Conservation had conducted proper environmental impact assessments under the Montana Environmental Policy Act.
