Roche, Allergan Sue Apotex Again Over Acular Patent

Law360, New York (June 06, 2005, 12:00 AM ET) -- Swiss drug maker Roche and licensee Allergan Inc. have sued Canadian generics maker Apotex in a California federal court over its plans to make a generic version of the eye-inflammation treatment Acular.

The complaint, filed by Roche Palo Alto LLC and Allergan, was filed shortly after the U.S. Court of Appeals for the Federal Circuit granted Apotex a second chance to seek the invalidation of a patent for Acular.
