Law360, New York (June 22, 2012, 10:12 PM ET) -- Pharmacia Corp., a unit of Pfizer Inc., must pay $13.5 million in damages for exaggerating the cost of prescription drugs supplied to Medicaid beneficiaries in Wisconsin, the state’s supreme court ruled Friday.
The opinion rejected a Pharmacia appeal on all fronts, concluding the company was appropriately subjected to a jury trial, that state lawmakers would have slashed reimbursements if they’d known true wholesale prices, and that a lower court properly determined the number of times the company committed Medicaid fraud.
