High Court Turns Down $5.6M Kia Brake Defect Appeal

Law360, New York (June 25, 2012, 3:18 PM ET) -- The U.S. Supreme Court on Monday declined to hear Kia Motors America Inc.'s appeal of a $5.6 million class action award over allegedly faulty brake systems in the Kia Sephia that Kia claimed violated its due process rights by using one plaintiff's damages to calculated an aggregate award.

The class of Sephia drivers had argued that Kia waived its right to make that argument by failing to raise it until the case was on appeal before the Pennsylvania Supreme Court.
