ABM Security Guards Win $90M In Break Period Suit

Law360, New York (July 9, 2012, 1:08 PM EDT) -- A California state judge on Friday ordered facilities management company ABM Industries Inc. to pay almost $90 million in damages to a class of security guards who alleged the company put them “on call” during break periods.

After considering the security guards' motion for summary judgment, California Superior Court Judge John S. Wiley handed down the damages award, finding that an ABM policy that allegedly required the guards to carry radios during breaks violated the state's labor code.
