NY Law Barring Foreign Pharmacists Found Unconstitutional

Law360, New York (July 10, 2012, 6:00 PM EDT) -- The Second Circuit ruled Tuesday that a New York law barring temporary foreign workers from being employed as pharmacists in the state is unconstitutional, finding that it discriminates against foreigners who have been legally allowed to live and work in the U.S.

A three-judge panel upheld a district court's ruling that held the statute in question is unconstitutional since it violates the equal protection and supremacy clauses of the U.S. Constitution.
