DynCorp Says US Drug Policy Bars Ecuadoreans' Herbicide Suit

Law360, New York (July 13, 2012, 6:05 PM ET) -- Government contractor DynCorp International Inc. asked a federal judge Thursday to grant it summary judgment in a suit over an herbicide-spraying anti-narcotic effort at the Colombia-Ecuador border, saying a law giving the president authority to take such action preempts the suit's claims.

Sweeping statutory language that allows the president to undertake international drug-control efforts as he sees fit “notwithstanding any other provision of law” on its face bars after-the-fact legal action, putting DynCorp in the clear, the partially redacted motion said.
