AmEx Told To Hand Over Docs In Merchants' Antitrust Case

Law360, New York (July 16, 2012, 9:54 PM EDT) -- A New York federal judge ruled Friday that American Express Co. must produce papers in an antitrust class action that it had previously provided to the U.S. Department of Justice, finding AmEx had waived attorney work product protection for the documents.

U.S. Magistrate Judge Ramon E. Reyes Jr. held that since AmEx had voluntarily handed over the documents concerning nondiscrimination rules to the Justice Department in a previous effort to convince the government not to bring suit against the company, the documents are not protected....
