Calif. Overtime Exemption Sticks To Federal Principles

Law360, New York (September 27, 2007, 12:00 AM EDT) -- One should not accept too readily the claims made in the article that appeared in this space entitled, “California, Feds Differ on ‘Exempt’ Administrators” (September 18, 2007).

Contrary to suggestions made in the article, the California Courts of Appeal have faithfully adhered to longstanding federal law principles in construing and applying California’s “administrative” exemption from overtime pay requirements, both in the case of insurance claims adjusters, and also in the one case involving an information technology/computer employee.
