6th Circ. Closes Title Insurance Price-Fixing Case

Law360, Los Angeles (July 17, 2012, 4:32 PM EDT) -- The Sixth Circuit on Tuesday affirmed the dismissal of a consolidated class action accusing 22 title insurers of conspiring with an Ohio rating bureau to fix prices, saying the federal McCarran-Ferguson Act and Ohio law bar state and federal antitrust claims.

A three-judge panel held that U.S. District Judge Sara Lioi ruled correctly when she found federal antitrust law defers to state regulation of title insurance, and Ohio law allows the allegedly collusive behavior.
