EU Court OKs Extended Patents For New Uses Of Old Drugs

Law360, New York (July 19, 2012, 7:53 PM EDT) -- Europe's highest court ruled Thursday that drug companies can obtain extended patent protection when they develop a new medical use for a known product, a ruling attorneys said reshaped the law and will be a boon to the pharmaceutical industry.

The decision involves an aspect of European Union patent law known as supplementary protection certificates, or SPCs, which provide additional patent protection for pharmaceutical products beyond the expiration date to compensate for the time needed to get regulatory approval for the products.
