W.Va. Supreme Court To Define Mine Inspection Liability

Law360, New York (July 23, 2012, 8:34 PM EDT) -- The West Virginia Supreme Court of Appeals has agreed to take up the question of whether federal mine inspectors can be held liable for the deaths of two miners killed in a 2006 fire at a mine run by a Massey Energy Co. subsidiary.

The state high court's action came just two days after the Fourth Circuit ruled that the resolution of a crucial question in the case belonged in state, not federal, court.
