SLAPP Law Doesn't Apply In Superman IP Row, 9th Circ. Hears

Law360, New York (July 25, 2012, 9:28 PM EDT) -- A trial court was right when it found that California's anti-SLAPP law didn't apply to DC Comics' business interference claims in a legal battle with heirs of Superman's co-creators and others over rights to the iconic superhero, DC told the Ninth Circuit on Tuesday.

Not only was the rejection of the defendants' bid for dismissal of DC's three state law claims under California's anti-SLAPP law proper, but the Ninth Circuit lacks jurisdiction over the defendants' interlocutory appeal, DC said in an appeals brief.
