Medical Leave Suit Goes Foward Against Dow

Law360, New York (October 1, 2007, 12:00 AM EDT) -- A federal appeals court has revived a case brought by a former operating technician who claimed that The Dow Chemical Co. fired her for taking extended periods of medical leave.

The U.S. Court of Appeals for the Sixth Circuit concluded Monday that the district court should not have granted summary judgment to Dow, which was accused of violations of the Family Medical Leave Act and Ohio anti-discrimination laws and wrongful discharge. The appeals court reversed the judgment and remanded all three claims.
