Calif. Appeals Court Rejects Employer Arbitration Pacts

Law360, New York (July 31, 2012, 7:05 PM EDT) -- A California appeals court handed down two employee-friendly decisions on Monday concerning the enforcement of arbitration agreements in a pair of employment law cases, refusing to compel arbitration in suits against JPMorgan Chase Bank NA and Vista Del Mar Child and Family Services.

In both cases, panels from the Second Appellate District determined that the arbitration agreements between the employee bringing the suit and the employer were unconscionable and affirmed lower court ruling's to reject the employer's bid to send the case to arbitration.
