Plaintiffs Look To Amend Caterpillar ERISA Complaint

Law360, New York (October 5, 2007, 12:00 AM EDT) -- The plaintiffs in a class action lawsuit against Caterpillar Inc. over retiree medical benefits are looking to amend their complaint after catching the heavy equipment maker in what they called a bold-faced lie.

In court documents filed Thursday with the U.S. District Court for the Middle District of Tennessee, the plaintiffs said surviving spouses of deceased retirees had been left out of the class because they were supposedly not being charged premiums.
