Patent Troll Bill May Be Too Vague, Narrow To Rein In Suits

Law360, New York (August 08, 2012, 10:33 PM ET) -- New legislation aimed at cracking down on technology patent litigation by nonpracticing entities could keep some suits from being filed, attorneys say, but the bill's ambiguous language and narrow scope could limit its effectiveness.

Introduced Aug. 1, the Saving High-Tech Innovators from Egregious Legal Disputes Act, or Shield Act, would allow the defendant in a patent suit over computer hardware or software to recover attorneys' fees and costs if a court rules the plaintiff doesn't have "a reasonable likelihood of succeeding."
