Insurer Says Conrail Not Covered In Workers' Pollutant Suit

Law360, Philadelphia (August 13, 2012, 3:32 PM EDT) -- Continental Insurance Co. filed suit Friday against Consolidated Rail Corp. in Philadelphia’s Court of Common Pleas, seeking to avoid covering claims filed by former Conrail employees holding the rail freight company responsible for their inhalation of pollutants.

Continental contends that the applicable policies contain pollution exemptions that excuse it from indemnity and that Conrail was too late in informing it of the claims.
