Court Loosens Restrictions On Calif. Health Whistleblowers

Law360, New York (August 14, 2012, 10:13 PM EDT) -- A California appeals panel on Wednesday rejected the contention that a whistleblower must exhaust all judicial writ options before filing suit under the state health code’s whistleblower provision, saying workers must not fear retribution when reporting threats to public health.

The panel held that a doctor fired for fighting with nurses who he said were endangering patients' lives could move forward on his whistleblower retaliation claim against the hospital, saying he didn't have to exhaust judicial remedies before filing suit.
