Judge Will Not Consider Caterpillar's Sur-Reply

Law360, New York (October 10, 2007, 12:00 AM EDT) -- A federal judge has shot down Caterpillar Inc.'s request to file additional court papers alleging that the plaintiffs in a lawsuit over retiree medical benefits made a “mountain out of a molehill” by accusing the heavy equipment maker of lying about who is eligible to join the class.

Without giving an explanation, Judge Aleta A. Trauger of the U.S. District Court for the Middle District of Tennessee on Tuesday denied Caterpillar's motion for leave to file an instanter sur-reply in opposition to the plaintiffs' amended complaint....
